Business and Noninstructional Operations
Lottery and Proposition 98 ADA Funds
Funds received pursuant to the California State Lottery and the Classroom
Instructional Improvement and Accountability Act (State Constitution, Article
XVI, Section 8.5) shall be deposited in separate accounts and shall be
maintained and appropriated separately from other funding sources. Such
funds shall supplement other resources and shall not supplant any other
funds. (Education Code 41300.1)
The District administration shall determine the amounts available
and time lines for expenditures.
The District administration shall establish reasonable ratios
of funds between the District and the various sites and programs. The funds
generated by Adult Education and/or ROC/P shall be made available only
to the District unit that generated the funds.
Funds shall not be expended or encumbered before they are received
by the District and should be used for a school site instructional activities
which directly benefit the instruction of students. Such activities shall
be limited to the following: (Education Code 41300.1)
1. Instructional supplies, instructional equipment, instructional
materials, and support services and equipment necessary to improve school
conditions.
2. Direct student services needed to ensure that each student makes
progress.
3. Staff development which improves services to students or increases
the quality and effectiveness of instructional staff, designed and implemented
by classroom teachers and other participating district personnel, including
District principals, with the aid of outside personnel as necessary.
Committee(s) shall be established that have representatives made up
of at least the following groups:
1. Contract teacher
2. Hourly teacher
3. Student
4. Site administrator
5. Community/Business Advisory Committee Member
6. Other as approved by the Superintendent

The committee(s) shall establish appropriate procedures for the solicitation
of proposals for the use of funds within the parameters established by
the corresponding Board policy. The committee(s) shall review proposals
and submit a recommended plan for the proper use of the funds to the Superintendent.
The Superintendent shall review the plan and make a recommendation
to the Board as the Superintendent deems appropriate.
