Disruptions
The principal, designee or
District security officer may direct an individual to leave District grounds if
he or she has a reasonable basis for concluding that the person is committing
an act that is likely to interfere with the peaceful conduct of District
activities or that the person has entered the campus with the purpose of
committing such an act. This shall not apply to students, Governing Board
members or employees of the District, or others required by their employment to
be on District grounds.
When an individual is
directed to leave under such circumstances, the principal or designee shall
inform the person that he or she will be guilty of a misdemeanor subject to a
fine and/or imprisonment if he or she reenters any District facility within 30
days after being directed to leave, or within seven days if the person is a
parent or guardian of a student attending school at that site.
If an individual refuses to
leave upon request or returns before the applicable period of time, the
principal or designee shall notify law enforcement.
The principal or designee
may direct any specified sex offender or drug offender to leave District
grounds. This does not apply to a student, parent or guardian of a student
attending that school site, or an individual who has obtained prior written
permission for entry from the principal or designee. Upon directing the individual
to leave, the principal or designee shall inform the person that he or she will
be guilty of a crime if he or she reenters the school site within seven days or
otherwise establishes a pattern of unauthorized entry.
Possession of unauthorized
dangerous instruments, weapons or devices is prohibited on District premises,
or any public right-of-way immediately adjacent to District property, or any
other place where a teacher and student(s) are required to be for assigned
school activities.
Appeal Procedure
Any person who is asked to
leave a public school building or grounds may appeal to the Superintendent or
designee. This appeal shall be made no later than the second school day after
the person has departed from the school building or grounds. The Superintendent
or designee shall render his or her decision within 24 hours after the appeal
is made, and this decision shall be binding.
The decision of the
Superintendent or designee may be appealed to the Governing Board. Such an
appeal shall be made no later than the second school day after the
Superintendent or designee has rendered his or her decision. The Board shall
consider and decide the appeal at its next scheduled regular or adjourned
regular public meeting. The Board's decision shall be final.
